HOME OFFICE CIVIL PENALTIES
Illegal working fines: two cancelled penalties for Care Recruitment Agencies
CASE 1
Penalty withdrawn after appeal
A care recruitment agency approached Stephen after receiving a Home Office civil penalty. An objection was submitted but declined. Stephen lodged an appeal and continued corresponding with Home Office representatives about the legal basis for the penalty.
Following further consideration, the Home Office withdrew its case.
OUTCOME: FINE CANCELLED IN FULL
CASE 2
Fine cancelled following objection
Another care recruitment agency sought help after receiving a civil penalty. Stephen prepared and submitted an objection on 24 December 2025, setting out the agency’s position and supporting arguments.
The Home Office confirmed 13 days later that the penalty had been cancelled.
OUTCOME: FINE CANCELLED IN FULL
Legal Approach in Case 1 and Case 2
In these matters, Stephen challenged whether the workers fell within the relevant definition of employee. The representations examined the relationship in practice, including mutuality of obligation, control and personal service, drawing on the principles discussed in Ready Mixed Concrete (South East) Ltd v Minister of Pensions and National Insurance [1968] 2 QB 497.
The application of these arguments depends on the facts and the law applicable to each case. A separate County Court hearing was described as pending in the supplied material; no court outcome is claimed here.

IMMIGRATION CASE STUDY
Evidence that helped secure leave to remain
In an earlier case, a Romanian national sought leave to remain in the UK after describing attacks connected with political activity during the Ceaușescu era.
Stephen investigated a specific detail the client recalled: a vehicle registration prefix associated with the alleged government agents. Corroborating information obtained from the British Ministry of Defence supported the client’s account. Leave to remain was granted.
Advice for complex histories
Citizenship and indefinite leave to remain applications can raise difficult questions about character, immigration history, residence and eligibility. Stephen begins by understanding the full circumstances, including anything a client may be concerned about disclosing.
He then advises on the applicable requirements and prepares an application that addresses relevant issues openly and accurately. Concealing material information can seriously harm an application.
